We are very happy to announce the end of the competition. We would like to congratulate all participants for their extraordinary flowerbeds and incredible passion for plants. Thank you for sharing your beautiful gardens and we keep our fingers crossed for the further development of floral compositions!
Since we received a lot of delightful, imaginative and passionate arrangements, we once again decided to increase the number of finalists and add consolation prizes – that’s the way it is with us with contests 😊

COMPETITION

INSTAGRAM CONTEST TERMS AND CONDITIONS AS OF 05/07/2023

§ 1. GENERAL PROVISIONS

1. The organizer of the contest on Instagram (hereinafter referred to as the “Contest”), is ML Sp. z o.o., based at 7 Berylowa Street, 82-310 Gronowo Górne (hereinafter referred to as the “Organizer”).
2. The founder of the prize is the Organizer.
3. The administrator of the personal data provided by the Contest Participants is the Organizer.
4. Providing personal data is arbitrary, but necessary for the Participant to enter the Contest. Persons providing data have the right to access, modify or delete such data.
5. These Regulations set forth the terms and conditions of the Competition.
6. The contest is not created, administered, supported or sponsored by Instagram.
7. The contest is conducted on the profile of stellagreen_en (https://www.instagram.com/stellagreen_pl/).
8. Supervision over the correctness and conduct of the Contest, i.e. providing information about the Contest and handling complaints is exercised by the Organizer.

§ 2. COMPETITION PARTICIPANTS

1. Participants in the Contest may only be natural persons, consumers as defined by Article 221 of the Civil Code, with full legal capacity, who are users and have an active account on Instagram; who by participating have accepted these Regulations (hereinafter: “Participant”).
2. The participant declares that:
3. Is a natural person with full legal capacity;
4. has familiarized himself with the contents of these Regulations and voluntarily enters the Contest;
5. agrees and accepts the terms and conditions of the Terms and Conditions, including having read and fully accepts the contents regarding the procedure for receiving the prize;
6. undertakes to abide by the provisions of the Terms and Conditions, including the rules of Instagram;
7. consented to the processing of personal data for purposes related to participation in the Contest;
8. Is a registered User of the social network Instagram.

§ 3 AWARD

1. The Contest provides a prize – for 10 people selected in the manner indicated in §6.
2. The prize is a set of garden palisade 3,14 m Stella Green + gloves.
3. Information about the Prize will be included in the content of the Contest announcement published on Instagram, on the profile stellagreen_en(https://www.instagram.com/stellagreen_pl/) and on the website www.stellagreen.pl
4. Winners are not entitled to exchange the Prize for cash or any other type of prize.
5. Winners may surrender the Prize, but in return they are not entitled to a cash equivalent or any other prize.

§ 4. PLACE, TIME AND RULES OF THE COMPETITION

1. The contest is available in the form of a contest announcement (hereinafter: “contest post”) on the social network Instagram on the Organizer’s profile at https://www.instagram.com/stellagreen_pl/.
2. In addition, information about the contest along with the rules will be posted by the Organizer on its website at stellagreen.pl (blog)
3. The contest runs from 5.07.2023 12:00 pm to 22.07.2023 11:59 pm.

§ 5. RULES OF PARTICIPATION IN THE COMPETITION

1. The task of the Contest Participant is:
2. Posting under the contest post an answer to the contest question: “what flowers are best for flower beds?”.
3. Sharing the contest post by the participant in his account and tagging the organizer’s profile.
4. Take a competition photo of your floral arrangement and email it to marketing@stellagreen.pl

§ 6. CONDITIONS OF PARTICIPATION IN THE COMPETITION AND RECEIPT OF PRIZES

1. Access to the Contest is free and requires registration on the social network Instagram.
2. The condition for participation in the Contest is acceptance of the Regulations and correct performance of all tasks described in § 5. Paragraph 1 of the Regulations.
3. The awarding of the prize will be decided by the Organizer by analyzing the correctness and attractiveness of the performance of the tasks described in § 5. Paragraph 1 of the Regulations by the Contest Participants. An additional advantage will be the inclusion of Stella Green products in the photo.
4. The organizer will select 10 winners from among the submitted entries.
5. The winner of the Contest will be notified of the prize and the conditions for collecting the Prize via a private message sent in the form of a return email within 14 working days after the end of the contest.
6. Public information about the winner will also be posted in a comment on the contest post on the Instagram profile of stellagreen_en and on the website www.stellagreen.pl (blog)
7. In order for the awarded Participant to receive the prize, he/she must send a private message on the Organizer’s profile with the following details within 48 hours of the announcement of the Contest results:

10. phone number
11. email address
12. Failure to send the message referred to in item. 7 or exceeding the permissible response time or sending incorrect data will cause the participant to forfeit the right to the prize.
13. The prize awarded in the Contest will be sent to the participant up to 10 working days after the Organizer receives the information referred to in paragraph 6.
14. The prizes will be sent at the expense of the Organizer as a courier service to the address indicated by the Participant, with the proviso that this obligation includes shipping only within the territory of the Republic of Poland.

§ 7. ORGANIZER’S RESPONSIBILITIES

1. The Organizer is not responsible for the accuracy and truthfulness of the data of the Contest Participants, including the inability to transfer prizes, for reasons attributable to the Participant, in particular, if the Participant did not provide a true mailing address or the data provided is incomplete or outdated.
2. The Organizer declares that it does not control or monitor the content posted by Participants in terms of reliability and truthfulness, subject to actions related to the removal of violations of the Terms of Use or generally applicable laws.
3. The Organizer reserves the right to exclude from the Contest Participants whose actions violate the law or the Rules and Regulations of Instagram, in particular participants who:
4. a) post content that does not comply with the applicable law or the Rules and Regulations available on Instagram (in particular, containing offensive content, both in the textual and graphic layers);
5. (b) take actions using an account/profile created in violation of Instagram rules;
6. (c) take actions using third-party accounts/profiles that do not comply with Instagram rules;
7. (d) interfere with the mechanism of the Competition;
8. (e) create fictitious accounts/profiles on Instagram
9. The organizer is not responsible for any malfunctions in the operation of ICT links, servers, interfaces, browsers and the Instagram platform.
10. The organizer is not responsible for the temporary or permanent blocking of a page or application from the Instagram website.

§ 8. PROCESSING OF PERSONAL DATA

1. Personal data of the Contest Participants will be processed by the Organizer only for the purpose of performing activities necessary for the proper conduct of the Contest.
2. The personal data of the Contest Participants will be kept by the Organizer only for the period necessary to conduct the Contest and to issue prizes to the awarded Participants.
3. Participants have the right to inspect the processed data and to correct and delete them. Data is provided on a voluntary basis, with registration on the Instagram social network required for participation in the Contest.
4. Upon deletion of data, the User loses the opportunity to participate in the Contest.

§ 9. COPYRIGHT

1. 1. At the moment the Participant sends the Form to the Organizer, according to the rules specified in the Regulations – the Participant grants the Organizer a non-exclusive, free and territorially unlimited license for an unspecified period of time, to use the photograph prepared by the Participant, which is a competition entry, in the fields of exploitation indicated below.
   2. The license referred to in paragraph 1 is granted for the following fields of exploitation, to the extent that they take place within the scope of the Organizer’s activities:

1. use of the work or its copies, in any form and in any way, including in particular the use of the photograph or its development for marketing purposes related to the activity of the Organizer, including in particular on the Internet, printed materials, the Organizer’s offer;
2. development, adaptation, rearrangement of the work or any other changes or modifications in the work or copies thereof;
3. The right to adapt or modify the functionality of the work (including copies thereof);
4. The right to use the work, its copies or their graphic representation for the purposes of promotion, marketing and advertising, in any manner and form, including the distribution of photographs through any media, especially the Internet;
5. In terms of recording and reproduction of the work – production of copies of the work by a specific technique, including printing, reprography, magnetic recording and digital technique;
6. In terms of circulation of the original or copies on which the work was fixed – marketing, lending or renting of the original or copies;
7. with regard to dissemination of the work in a manner other than that specified in letter f.- public performance, exhibition, display, reproduction, as well as broadcasting and rebroadcasting, as well as making the work available to the public in such a way that everyone can have access to it at a place and time of their own choosing.

3. As part of the licensing of the work in accordance with the provisions of paragraphs 1 and 2, the Participant also grants the Organizer the right to exercise derivative rights to the work or copies thereof and to authorize the use and disposal of the derivative works.

4. In the case of the awarded Participants, the Organizer acquires copyright to the photographs submitted by these Participants in accordance with the provision of Article 921 § 3 of the Civil Code. The transfer of copyrights shall take place in the fields of exploitation indicated in paragraph 2.
5. By submitting the Form, the Participant declares that he/she is the author of the photograph submitted as part of the Contest, has all rights to the photograph he/she submits, and that it is not restricted by any rights of third parties.

§ 10. COMPLAINTS AND REPORTS OF VIOLATIONS

1. The right to file complaints is available to any Participant.
2. The Organizer will consider complaints within 14 days of receipt. If the complaint needs to be supplemented – the Organizer will ask the complainant to supplement the complaint.
3. The complaint should be submitted in writing and sent by registered mail to the Organizer’s address. The Organizer recommends that the complaint application should indicate the identification data of the complainant.

§ 11. FINAL PROVISIONS

1. In matters not covered by these Regulations, the provisions of the Civil Code and other provisions of law shall apply.
2. Disputes relating to and arising out of the Contest will be resolved by the common court having jurisdiction over the Organizer’s headquarters.
